TERMS AND CONDITIONS OF USE
Kansas Property Analytics System
Effective Date: December 12, 2025
IMPORTANT NOTICE: This is a legally binding agreement between you (the "User" or "You") and Kansas Property Analytics (the "System" or "Service"). By accessing and using this System, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not access or use this System.
ARTICLE I. DEFINITIONS AND INTERPRETATION
1.1 Definitions. For purposes of these Terms and Conditions:
- "System" means the Kansas Property Analytics web-based application and all related services.
- "User" means any individual authorized to access the System under these terms.
- "County Appraiser" means the elected or appointed official responsible for property appraisal in a Kansas county.
- "Property Data" means all information, records, and data related to real property accessible through the System.
- "Authorized Purpose" means official governmental property appraisal activities as defined in Section 3.
1.2 Interpretation. Headings are for convenience only and shall not affect interpretation. References to "including" shall be construed as "including without limitation."
ARTICLE II. ACCEPTANCE AND SCOPE
2.1 Binding Agreement. By creating an account, verifying your email address, or accessing the System in any manner, you expressly agree to be bound by these Terms and Conditions and all applicable laws and regulations.
2.2 Entire Agreement. These Terms and Conditions, together with our Privacy Policy (incorporated herein by reference), constitute the entire agreement between you and Kansas Property Analytics regarding use of the System.
2.3 Amendments. We reserve the right to modify these terms at any time. Material changes will be effective upon posting to the System. Continued use following such changes constitutes acceptance of modified terms.
ARTICLE III. ELIGIBILITY AND AUTHORIZATION
3.1 Eligibility Requirements. To access and use the System, you must:
- Be at least eighteen (18) years of age;
- Be employed or under contract with a Kansas county government entity;
- Have specific written or electronic authorization from your County Appraiser to access the System;
- Provide accurate, current, and complete registration information; and
- Maintain and promptly update all registration information to keep it accurate and current.
3.2 Account Approval. Account activation is subject to verification and approval by your County Appraiser. Kansas Property Analytics reserves the right to refuse service to anyone for any reason at any time.
3.3 Account Security. You are solely responsible for:
- Maintaining the confidentiality of your login credentials;
- All activities occurring under your account, whether or not authorized;
- Immediately notifying Kansas Property Analytics of any unauthorized use or security breach; and
- Ensuring you log out of your account at the end of each session when using shared computers.
ARTICLE IV. PERMITTED AND PROHIBITED USES
4.1 Permitted Uses. You may use the System solely for the following Authorized Purposes:
- Conducting official county property appraisal duties;
- Reviewing and analyzing residential property characteristics and valuations;
- Performing grade reviews and Code Definition Unit (CDU) assessments;
- Analyzing sales data and comparable property studies;
- Accessing training and educational materials related to property appraisal; and
- Other lawful governmental purposes expressly authorized by your County Appraiser.
4.2 Prohibited Activities. You expressly agree NOT to:
- Share, transfer, or disclose your account credentials to any third party;
- Access Property Data for counties other than your authorized jurisdiction without explicit permission;
- Use the System or Property Data for personal financial gain, commercial purposes, or any non-governmental use;
- Attempt to gain unauthorized access to any portion of the System, other accounts, computer systems, or networks;
- Introduce or transmit any viruses, worms, malware, or other malicious code;
- Engage in any automated data collection, scraping, crawling, or harvesting of content without express written permission;
- Interfere with, disrupt, or impose unreasonable burden on the System's infrastructure;
- Circumvent, disable, or interfere with security features or access controls;
- Share, publish, distribute, or publicly disclose confidential Property Data to unauthorized persons or entities;
- Use the System in any manner that violates applicable federal, state, or local laws or regulations; or
- Engage in any activity that could damage, disable, overburden, or impair the System.
ARTICLE V. DATA CONFIDENTIALITY AND PRIVACY
5.1 Confidential Information. You acknowledge that Property Data accessible through the System may constitute confidential information protected by Kansas state law, federal privacy regulations, and common law principles.
5.2 Confidentiality Obligations. You agree to:
- Maintain strict confidentiality of all Property Data accessed through the System;
- Use Property Data exclusively for Authorized Purposes as defined herein;
- Comply with all applicable Kansas Open Records Act (K.S.A. 45-215 et seq.) requirements;
- Comply with all applicable federal privacy laws, including but not limited to Privacy Act of 1974;
- Not disclose personally identifiable information of property owners to unauthorized third parties;
- Implement reasonable security measures to prevent unauthorized disclosure; and
- Immediately report any actual or suspected data breach or unauthorized disclosure.
5.3 Data Retention. You shall not retain copies of Property Data beyond the period necessary for legitimate governmental purposes, unless required by law.
ARTICLE VI. INTELLECTUAL PROPERTY RIGHTS
6.1 Ownership. All content, features, functionality, software, text, displays, graphics, photographs, data compilations, and other materials contained in or generated by the System (collectively, "System Content") are owned by Kansas Property Analytics, its licensors, or other content providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
6.2 Limited License. Subject to your compliance with these Terms and Conditions, Kansas Property Analytics grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the System solely for Authorized Purposes.
6.3 Restrictions. You shall not: (a) copy, modify, create derivative works from, or reverse engineer any System Content; (b) remove or alter any copyright, trademark, or proprietary notices; or (c) use any System Content for purposes other than those expressly authorized herein.
ARTICLE VII. DISCLAIMERS AND LIMITATIONS OF LIABILITY
7.1 "AS IS" Provision. THE SYSTEM AND ALL PROPERTY DATA ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
7.2 No Warranty of Accuracy. Kansas Property Analytics does not warrant that:
- Property Data will be accurate, complete, current, or reliable;
- The System will be uninterrupted, secure, or error-free;
- Defects or errors will be corrected; or
- The System is free of viruses or other harmful components.
7.3 Verification Required. You acknowledge that Property Data is derived from multiple sources and may contain errors, omissions, or outdated information. You are solely responsible for verifying all critical information through official county records and other authoritative sources before relying upon it for official decisions.
7.4 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KANSAS PROPERTY ANALYTICS, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SYSTEM, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
7.5 Indemnification. You agree to defend, indemnify, and hold harmless Kansas Property Analytics and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms and Conditions or your use of the System.
ARTICLE VIII. TERM AND TERMINATION
8.1 Term. These Terms and Conditions remain in full force and effect while you access or use the System.
8.2 Termination for Cause. Kansas Property Analytics reserves the right, in its sole discretion, to immediately suspend or terminate your access to the System, with or without notice, for any reason, including but not limited to:
- Breach of any provision of these Terms and Conditions;
- Request from your County Appraiser for account deactivation;
- Termination of your employment or contract with the county;
- Detection of fraudulent, abusive, or suspicious activity;
- Violation of applicable laws or regulations; or
- Extended periods of account inactivity.
8.3 Effect of Termination. Upon termination: (a) your right to access and use the System immediately ceases; (b) you must cease all use of System Content; (c) all confidentiality obligations survive; and (d) Kansas Property Analytics may delete your account data.
8.4 Survival. Articles I, V, VI, VII, IX, and X shall survive any termination or expiration of these Terms and Conditions.
ARTICLE IX. GOVERNING LAW AND DISPUTE RESOLUTION
9.1 Governing Law. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Kansas, without giving effect to any principles of conflicts of law.
9.2 Jurisdiction and Venue. Any legal action or proceeding arising under these Terms and Conditions shall be brought exclusively in the state or federal courts located in Kansas, and you hereby consent to personal jurisdiction and venue therein.
9.3 Waiver of Jury Trial. TO THE EXTENT PERMITTED BY LAW, YOU HEREBY WAIVE ANY RIGHT TO A JURY TRIAL IN ANY PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS AND CONDITIONS.
9.4 Statute of Limitations. Any claim arising from these Terms and Conditions must be filed within one (1) year after the cause of action accrues, or such claim shall be permanently barred.
ARTICLE X. GENERAL PROVISIONS
10.1 Severability. If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
10.2 Waiver. No waiver of any provision of these Terms and Conditions shall be deemed a further or continuing waiver of such provision or any other provision.
10.3 Assignment. You may not assign or transfer these Terms and Conditions or your rights hereunder without prior written consent from Kansas Property Analytics. Kansas Property Analytics may assign these terms without restriction.
10.4 Force Majeure. Kansas Property Analytics shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, or failure of telecommunications or internet services.
10.5 Notices. All notices required under these Terms and Conditions shall be in writing and delivered to:

10.6 Technical Support. For technical assistance or account-related inquiries, contact your County Appraiser directly.
10.7 Electronic Communications. You consent to receive electronic communications from Kansas Property Analytics, and you agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
ARTICLE XI. ACKNOWLEDGMENT AND ACCEPTANCE
11.1 Acknowledgment. BY CLICKING "I ACCEPT THE TERMS & CONDITIONS AND PRIVACY POLICY" DURING REGISTRATION, OR BY ACCESSING OR USING THE SYSTEM IN ANY MANNER, YOU ACKNOWLEDGE THAT:
- You have carefully read and fully understand these Terms and Conditions;
- You have had the opportunity to seek independent legal advice regarding these terms;
- You voluntarily agree to be bound by these Terms and Conditions;
- You understand that you are entering into a legally binding agreement; and
- You have the legal capacity and authority to agree to these terms on behalf of yourself and, if applicable, your employing entity.
11.2 Electronic Signature. Your electronic acceptance constitutes your signature and agreement to be bound by these Terms and Conditions with the same legal effect as a handwritten signature.
